Dear Chair Cervantes, I respectfully urge a YES vote on AB 762 (Irwin), which would ban the sale of disposable vapes in California effective January 1, 2027 when it comes before you in the Senate Appropriations Committee. Disposable vapes are a public health, environmental, and worker safety crisis in a single product. Over 12 million are sold every month in the U.S., and each one contains an embedded lithium-ion battery with no viable recycling pathway. These batteries are driving a surge of fires at waste and recycling facilities across California, putting workers in danger and damaging critical infrastructure. Beyond the fire risk, disposable vapes leach heavy metals and residual nicotine into waterways and soil, and 72% of consumers don't even realize they're hazardous waste. Every year, discarded vapes waste 23.6 tons of lithium, enough to power over 2,600 electric vehicles for their entire lifetime. We cannot recycle our way out of this. AB 762 takes the right approach: require vape devices sold in California to be rechargeable, refillable, and designed with removable batteries. The U.K., France, Belgium, and New Zealand are already moving to ban disposable vapes. California should lead, not follow. We respectfully ask for the Chair's YES vote and support on AB 762.
